Citizens for Animal Rights, co-petitioners in the matter of stray dogs in the Hon’ble Supreme Court of India, have issued a legal notice to Indian Express Editor-in-Chief Raj Kamal Jha, alleging violation of the law in their article titled “Siblings mauled to death by stray dogs in South Delhi’s Vasant Kunj.” The article, published on March 13, 2023, was deemed unverified, damaging and falsified, with no legal evidence to support its claim. The notice warns that publishing such unlawful news, which is ongoing and sub-judice before the Supreme Court, violates Indian law and attracts serious criminal proceedings, including but not limited to sections 146, 153, 503, 63, 182, 191, 203, 211, 323, and 121 of the Indian Penal Code, 1860.
Citizens for Animal Rights have accused the Indian Express of committing contempt of the Supreme Court, influencing the view of the people, spreading hatred and fear for urban free-ranging animals and indirectly bringing harm upon the animals. They have further alleged that the publication of the article without formal press statements and video testimonials from the area violated the orders of the Supreme Court of India. The co-petitioners have called for legal action against the Indian Express and have sought the intervention of the Ministry of Information and Broadcasting, the Animal Welfare Board of India, and the Municipal Corporation of Delhi.
